Introduction
This privacy policy (“Privacy Policy”) describes the ways Viewpost North America and its parent, affiliates and subsidiaries (“We, “Us”, or “Viewpost”) collect, store, use, disclose, and protect your information. It also describes the choices available to you regarding our use of your Information (as discussed below) and how you can access and update this Information. By registering to use the Viewpost application through the website or mobile application you agree to the practices regarding your information described in this Privacy Policy and agree to Viewpost Terms of Use. The use of information collected through the service shall be limited to the purpose of providing the services.
Information We Collect
When you register and use Viewpost Services, we collect certain information that you provide to us during registration and throughout your use of the Viewpost Services related to your business and its practices. Examples include your company name, business representative’s name, business phone number, business address, business email address, financial information and transactional information associated with the company and taxpayer identification number utilized by the business. This information is described as “business information.” We use the term “personal information” to describe information that can be associated with a specific person and can be used to identify a specific person. This would include name, address, bank account number, Geo-location and Social Security number, if such data is necessary. Collectively business and personal information is referred to as “Information.” We may also collect and use Information provided by others about you or your business to provide the Viewpost Services and verify you or your business. Your Information does not include data that has been anonymized or de-identified so that it does not identify a specific person or data pertaining to a business entity or your capacity as a representative of a business entity. It is possible to browse the Viewpost Site (as such term is defined in the Viewpost Terms of Use) without actively submitting any Information. In addition, we may automatically collect data that does not identify you or your business and store it on log files such as your Internet Protocol (IP) address and/or domain, the type and version of your Internet browser software and operating system you use, the date, time, and duration of your Viewpost Site access, the specific pages, buttons, images, links, and forms that you access while visiting the Viewpost Site, the type of device you use to access the Viewpost Site (such as an iPhone or iPad), your mobile carrier and/or Internet Service Provider, and demographic data concerning the country of origin of your computer and the language(s) used by it. Collection of this data does not personally identify you. We may also use third-party applications and services, such as Google Analytics, to collect, analyze and aggregate this data.
Opt-Out Preferences
We may use your name and email address to send you business promotional emails or any updates regarding our products. Out of respect for your privacy, you may choose to stop receiving these marketing emails by following the unsubscribe instructions included in these emails, or you can contact Customer Support at 1-888-248-9190 or support@viewpost.com. We will also send invoices on behalf of our customers to your registered email address or the email address provided by your service provider. If you wish to stop receiving invoices in this manner, please contact the sender of these invoices as we have no mechanism to opt you out of those communications.
Our Use of Information
We may use your Information to (i) provide the Viewpost Services you use; (ii) provide to unaffiliated third parties Viewpost Services, such as our business trust marketing services; (iii) resolve disputes and issues with respect to the Viewpost Services; (iv) prevent potentially prohibited or illegal activities; (v) enforce our Terms of Use and any other agreements between you and Viewpost; (vi) improve, modify, customize, and measure the Viewpost Services and the Viewpost Site; (vii) deliver targeted marketing, service update notices, and promotional offers based on your communication preferences; (viii) compare information for accuracy and verify it with third parties; (ix) comply with laws, rules, regulations; and (x) detect and prevent fraud or other criminal activities.
Sharing Your Information In Connection with the Viewpost Services
In connection with the Viewpost Services, we may share some of your Information with the (i) businesses with which you are transacting through the Viewpost Services; (ii) businesses with which you are exchanging data through the Viewpost Services; (iii) financial institutions necessary to complete transactions; and (iv) businesses that use our trust marketing services. At any time Viewpost may share all Information collected when you visit the Viewpost Site or use the Viewpost Services with business partners, financial institutions and other third parties to comply with legal and regulatory requirements imposed on Viewpost or the third party. We may also share your Information, such as corporate ownership information, transactional and experience information and all its derivatives including but not limited to accounts payable, accounts receivable, cash flow, trading partner information, and sales with our strategic business partners to provide you an optimal experience and inform you of other potential opportunities. Where applicable, by express agreement, Viewpost binds these third parties with an obligation not to use any your Information they receive from Viewpost for any purpose other than to enable and use the Viewpost Services. Credit Cards
Viewpost utilizes third party processors to facilitate payments made by credit cards. Viewpost allows you the ability to directly pay or receive payments through third party card processors. All Information utilized to send and receive credit card payments is transmitted directly from you to that third party and it is not received by Viewpost. Please see their Privacy Policy to learn how that information is handled.
Sharing Your Information for Other Purposes
We may share your Information with (i) service providers who are authorized to use your business information only as necessary to support our business operations, such as those who provide data storage, payment, technology support and services, customer service, risk solution provision, analytics, fraud prevention, and marketing services; (ii) affiliated entities and entities that we plan to merge with, acquire or be acquired by; (iii) governmental authorities to comply with legal, regulatory or administrative requirements; (iv) law enforcement, government authorities, or other third parties in response to judicial or other governmental subpoenas, warrants and court orders, or otherwise when we believe we need to in order to comply with applicable law; (v) third parties to protect our rights or property, protect our legitimate business interests, or to enforce the provisions of our terms or policies, including, without limitation, to protect or defend us and any of our officers, directors, employees, agents, contractors, and partners, in connection with any legal action, claim or dispute; (vi) third parties when we believe in good faith that the disclosure of your Information is necessary to prevent harm or loss, to report suspected illegal activity, or in cases of customer fraud or disputes; (vii) bankruptcy trustees, successors-in-interest, asset purchasers and other third parties; (viii) third parties as disclosed in other applicable policies, terms of use, or other agreements; or (ix) third parties as authorized by you.
Accessing, Updating, and Correcting Your Information
Upon request Viewpost will provide you with information about whether we hold any of your Information. The Viewpost Site enables you to update and correct your Information and delete inaccuracies. You can review and edit specific types of Information at any time by logging in to the Viewpost Site and making changes on its Settings page. We will retain your Information for as long as your account is active or in accordance with our data retention practices. Please note that we are not obligated to retain any Information except as required by law. If we are required to maintain a record of any Information, you may not be able to delete such Information due to such requirements. Please be aware that your Information stored on backup tapes and locations, third-party servers, and other repositories may not be erasable and residual Information may be retained. Viewpost will delete inaccurate Information upon notice from the customer when it does not conflict with applicable laws, rules, regulations, or other legal obligations. We will respond to your request within a reasonable time frame. In addition, Viewpost receives Information directly from its customers, and may have no direct relationship with the individuals to whom that Information relates. That Information is separate from the Information collected through the Viewpost Site. An individual who is not a Viewpost registered user who seeks to access, correct, amend, or delete data provided to us by our customer should direct those requests to the customer as they will have access to that Information through their own account. Viewpost acknowledges your right to access and amend your Information, however, that Information is part of another parties account and will need to be corrected by them. If requested to remove data we will respond within a reasonable timeframe. Though information may be collected or recorded, service details including call recordings and logs may not be shared.
Protected Health Information
Viewpost does not require, nor does it knowingly collect, protected health information (“PHI”) as defined by the Health Insurance Portability and Accountability Act (“HIPAA”). You are prohibited from providing PHI to us or from utilizing the Viewpost application to transmit PHI unless you have entered into a Business Associate Agreement with Viewpost.
Mobile Application
When you download and use our Services, we automatically collect information on the type of device you use and operating system version. We may send you push notifications from time-to-time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain Information about your device such as operating system and user identification information. We collect your location based information for the purpose of providing you with the names of customers on the Viewpost platform in your area for the purposes of connecting. We will only share this information with our mapping provider for the sole purpose of providing you this service. You may opt-out of location based services at any time by editing the setting at the device level. We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application.
Cookies and Similar Technology
When you access the Viewpost Site, we, or third parties we hire to track how our website, may place “cookies” or similar technologies on your computer or other access device. We use cookies to customize and optimize the Viewpost Services, content and advertising, measure promotional effectiveness, and otherwise promote trust and safety. We encode our cookies so that we, but not others, can readily access the data stored in them. We send a “session cookie” to your computer or other access device when you log into the Viewpost Site or otherwise use the Viewpost Services. This type of cookie helps us to recognize you if you visit multiple pages on our site during the same session, so that we do not need to ask you for your password on each page. Once you log out or close your browser, this cookie expires and no longer has any effect. We may also use “persistent” or longer-lasting cookies for other purposes, such as to record your user experience preferences when you use the Viewpost Services. These cookies do not expire once you log out or close your browser. You are free to decline our cookies if your browser permits, but doing so may interfere with your use of the Viewpost Site. We may also collect information about your computer or other access device to mitigate risk and for fraud prevention purposes. You may encounter cookies from third parties when using the Viewpost Services on websites that we do not control. We and our third-party advertising service providers may also use technologies similar to cookies to track your interaction with the Viewpost Site to provide you advertising on other sites and emails sent to you by Viewpost. Some of these technologies include web beacons, pixels, tags, scripts and Flash objects. As with cookies, you are free to decline such technologies if your browser permits or unsubscribe to marketing emails sent to you by Viewpost. You should refer to your browsers instructions to remove cached history and images from your device. Deleting or disabling cookies will not remove Flash objects. You should refer to Adobe’s website (www.adobe.com) for more information on how to disable these objects. Currently, our website does not respond to browser “do not track signals.”
Storage and Protection of Information
We store and process Information on computers in the United States and in other countries where Viewpost or its third-party service-provider facilities are located. Through your use of the Viewpost Services, you consent to the transfer of Information to the United States or other countries where Viewpost or its third-party service-provider facilities are located. We maintain administrative, technical, and physical safeguards that are designed to protect the privacy and security of Information. In order to help secure Information collected from you as a Viewpost Site User, including financial data and login information, the Information is protected by SSL encryption when it is exchanged between your web browser and the Viewpost Site. However, the Internet is not a fully secure environment, and we cannot ensure or warranty the security of any Information transmitted to or generated by Viewpost in connection with the Viewpost Site or Viewpost Services. There is no guarantee that Information may not be accessed, disclosed, altered, or destroyed by breach of any of our administrative, technical, and physical or other operational safeguards. You play a critical role in protecting your Information by maintaining up-to-date computer security protections. Steps you take to ensure the security of your computer, computer passwords, or other personal identifier authentication mechanisms are key components of the protection of your Information. You agree that you are responsible for any additional verification procedures and security you deem necessary. By using the Viewpost Services, you agree that the procedures provided for in this Privacy Policy and the procedures implemented on the Viewpost Site to protect Information and to verify the identity of users of the Viewpost Services, including, but not limited to, those procedures described in the foregoing paragraph, constitute commercially reasonable website security and customer verification procedures.
Suspicious Email
It is our policy not to email you or send you electronic communications to request account information (such as a username or password). If you receive an unsolicited email or other electronic communication that appears to be from Viewpost but you suspect may be from another source and might be fraudulent, please email us at fraudprevention@viewpost.com.
Social Media
You may also find additional information on our products and services through our social media sites such as Facebook, LinkedIn, or Twitter. Please keep in mind that any information you share is visible to all participants on these social media sites and you should never post any sensitive information (such as account number or tax identification). Please carefully review the terms of use and privacy policy on these social media sites as they may be different than our own policies.
Personal Information on Children
We respect the privacy of children and encourage all parents to supervise their children’s computer usage. We do not intend to invite children to visit the Viewpost Site, and we do not solicit or knowingly collect or retain any information from children under the age of thirteen (13).
Other Websites and Businesses
Please note that other websites you may visit or businesses with whom you may transact have their own privacy policies, and Viewpost is not responsible for their operations, including, but not limited to, their information practices. We encourage you to review the privacy and security policies of all third-party websites.
Referrals/Tell-a-Friend
If you choose to use our “invite to connect” function to invite a company or third party to join your Viewpost network, we will ask you for their contact information, including their email address. You can choose to invite a third party (a) at the time you establish them as a new vendor/customer, or (b) at a later point in time using our connect function. When registering a new vendor/customer, we will automatically send an email to this contact inviting them to join Viewpost, unless you unselect the invite box. In either case, Viewpost will store this information and may resend invitations to unregistered recipients. Email recipients may opt-out of future communications through the unsubscribe function in any email sent to them from Viewpost. We will also send emails containing invoices on your behalf once the invoice is created. If your customer wishes to no longer receive those invoices they will be directed to you to make that request. We will continue to send the invoices upon creation.
Notice to Persons Accessing the Viewpost Site Outside the United States
If you access the Viewpost Site outside the United States, any information you provide to us on the Viewpost Site will be transferred out of that jurisdiction and into the United States. If you do not want your Information to leave that jurisdiction, do not provide the Information to us. By providing any Information to us, you explicitly provide your free and knowing consent to the transfer of your Information to the United States.
